About Your Role:
We are seeking a highly motivated and experienced individual to join Custodia Bank as our BSA Officer. In this role, you will be responsible for overseeing and managing the Bank Secrecy Act (BSA) and Anti-Money Laundering (AML) compliance program, collectively our Financial Crimes Compliance team, ensuring Custodia's adherence to regulatory requirements in the rapidly evolving world of digital assets. Reporting directly to the Chief Compliance Officer, Custodia’s BSA Officer plays a critical role in safeguarding the integrity of our operations and fostering a culture of compliance.
- Oversees the Financial Crimes Compliance team that performs daily review, monitoring, and analysis of various reports, logs, and transaction data to identify trends, unusual activity, and monitor large currency activity; determines if transactions are suspicious in nature, such as kiting, significant changes in balances, cash structuring in deposits, loan payments, and certificate of deposit purchases, wires or ACH transfers, monetary instrument sales, new account openings, etc.
- Develops, implements, and maintains an effective BSA/AML compliance program tailored to the unique challenges of Bitcoin Custody.
- Monitors and assesses the institution's compliance with BSA/AML laws, regulations, and best practices.
- Oversees and enhances the transaction monitoring system to detect and report suspicious activities related to Bitcoin transactions.
- Conducts ongoing risk assessments specific to the Bitcoin Custody business, identifying and mitigating potential money laundering and terrorist financing risks.
- Ensures robust Know Your Customer (“KYC”) and Enhanced Due Diligence (“EDD”) processes for customer onboarding, due diligence, and ongoing monitoring, aligning with the unique characteristics of the digital asset landscape.
- Supervises the timely and accurate filing of Suspicious Activity Reports (SARs) as required by regulatory authorities.
- Contributes to comprehensive BSA/AML training programs for employees, fostering a strong culture of compliance throughout the organization.
- Reviews, updates, and develops policies and procedures to reflect changes in regulations and industry best practices related to Bitcoin Custody.
- Works closely with other departments, including Legal, Risk Management, and Operations, to ensure a coordinated approach to BSA/AML compliance.
- Prepares for and assists in regulatory examinations and audits related to BSA/AML compliance, maintaining a high level of readiness.
- Prepares and presents regular reports to senior management, summarizing the institution's BSA/AML compliance status, issues, and recommendations.
- Escalates risks or potential risks to the Chief Compliance Officer and senior leadership or the Board of Directors, as appropriate.
General Compliance:
- Proven experience in BSA/AML compliance within the financial services industry, with a focus on cryptocurrency or digital assets.
- Strong knowledge of Bitcoin custody operations and associated regulatory requirements.
- Excellent communication, interpersonal, and leadership skills.
- Ability to adapt to a dynamic regulatory environment and emerging trends in the digital asset space.
- Maintains a proficient knowledge of all applicable rules and regulations. Researches regulatory issues and responds to compliance questions from Bank personnel, using legal and regulatory reference materials, regulatory agencies, Bank legal counsel, and professional associations and organizations, as appropriate.
- Conducts self-assessments as scheduled.
- Assists in the development, revision or reviews of bank policies, procedures, disclosures, notices, and forms to comply with legislative and regulatory changes or new requirements.
We Are Looking For Someone Who Has:
- Ten years BSA Officer experience. Bachelor's degree in Business, Finance, or a related field.
- Current Association of Certified Anti-Money Laundering Certification (“ACAMS”).
- Previous experience managing a team as well as developing the staff professionally.
- Understanding of legislative and regulatory processes related to BSA/AML and OFAC regulations and experience with interfacing with external regulators.
- Excellent oral and written communication skills.
- Ability to proactively identify and address potential concerns and risks. Ability to resolve issues, work independently, and meet deadlines.
- Previous experience managing High Risk Enhanced Due Diligence requirements.
- 2-4 years compliance experience with a focus on stablecoin market a plus (experience with industry leaders such as Paxos, HUSD, Gemini preferred).
